What are the limits of the pardon?

The LCJ enumerates certain sexual offences. If a person receives a pardon for one of these violations, his file will be kept separate from other records, but an indicator will be associated with his name in the (CPIC) system. This means that an employer could ask for a person’s file if that person attempts to get a job which will put them in contact with children or other vulnerable people because of their age or disability.

2. What is a criminal record?
The criminal record is a record in a registry administered by the Royal Canadian Mounted Police (RCMP), and in which all the information on those found in violation of laws is kept. Even after several years and, even if it concerns a minor offence, the criminal record does not disappear automatically. These traces can be used to justify a harsher sentence in the event of further offences.

3. I have a criminal record but it has no impact on my life so far. Why would I need a Pardon?
In addition to the obvious reasons, which require you to apply for one, such as employment or travel abroad, people who have a criminal record are the most vulnerable to the extent that they can be easily suspected during their existence because their record does not automatically erased. It remains with the person throughout his life. Often, people simply want to get rid of past mistakes. Peace of mind is a common motivation for requesting for a Pardon.

4. How long will it take to get the Pardon?
This is a question most frequently asked to the consultants of our service and the answer is somewhat ambiguous, because each request is unique in its treatment and Pardons and Waivers are granted after a specific process in each case.

A number of contacts with other services is required during the process, such as the RCMP, the court, the local police, as well as the National Parole Board (or DHS), in order to define the specific request.
The treatment of a Pardon or a Waiver is a very serious process, which goes through several stages. Canada Pardon Services puts in place a platform specializing in the evaluation of the duration of the process depending on the data received by each applicant.

It is important to note that given the importance of obtaining forgiveness for many people with time constraints, the Canadian government is undertaking measures aimed at speeding up the process at the National Parole Board. Duration of the process may be more than 18 months in some cases. 5. What are the consequences of a criminal record?
The existence of a criminal record includes the following drawbacks:

Employment (affects your candidacy – loss of promotion or your job – limits access to jobs in the banking, insurance, government, hospital, legal, social, security and… the list is long)

6. If I have more than one offence, do I need a Pardon for each one of them?
No. Once you get the Pardon it is valid for all crimes showing on your criminal record, and all the offences are removed from the ICCP (the computer network of the RCMP).

7. If I am once again accused of a crime after obtaining a Pardon, what will happen?
The Pardon is no longer valid if you are accused of a new crime. If this is the case you would be entitled to apply for a second pardon. Otherwise, your criminal record will remain sealed for ever.

8. I am not sure if I need a Pardon or a Waiver, what do I do in this case?

11. Is rehabilitation obtained in Canada recognised in a foreign country?
The answer is no, because the Canadian Pardon has no value for several foreign countries, including the United States.
Thus, to visit the United States for example, you need permission from the American authorities, the so-called US-entry Waiver.

12. Will my criminal record be automatically deleted after a certain time?
Unfortunately it will not, you keep your criminal record even after several years and even if it involves a minor offence, the criminal record does not disappear automatically.

13. Can I enter the United States if I have a criminal record?
The American law on immigration is very strict regarding foreigners with a criminal record. Entry into the United States may therefore be refused to persons having a prior criminal record.

14. Does the Canadian Pardon allow me to enter the United States?
Pardon Canada or Pardons from other countries do not automatically allow you to enter the United States. Americans do not recognize the Pardon, and, if an American customs officer asks you about your background, even if you have obtained a Pardon, you must reveal the existence of your records. Consequently, if you plan to go to the United States, you will need to obtain a Waiver.

15. The American Waiver
The Waiver is a paper representing official permission granted by the American government, to people who are not allowed to legally enter the United States.

The consequences can be dramatic for those who are not aware or who take the risk to travel or even to pass through the territory without having the US Waiver. You may be refused entry at the border and your vehicle, belongings and air ticket may be taken away from you. You may even be detained and deported, just because of a simple shoplifting incident at the corner store a long time ago.

16. When can I apply for the Waiver?
The request for the right of entry into the United States (the Waiver) can be made at any time, and is granted at the discretion of a U.S. immigration officer.

The granting of the Waiver is based on the following:

The degree of your crime

Potential risks that you could represent to the United States

The reasons for your visit

The age of your conviction

Your situation

 

The process to get the Waiver is relatively long – all procedures and steps must be taken into account. It is strongly recommended that you make your request as soon as possible to avoid last minute disappointments.

17. How Soon Can I Apply?
Entry Waivers can be applied for at any time and are granted at the discretion of a U.S. immigration officer handling your file based on:

the risk you are considered to pose to the U.S.;

A few question in the order of padding out my work application..?
I want to work as a waitress at IHOP. It asks for ‘position(s) applied for’..is there a better term for waitress? Or is waitress fine? It asks for my highschool and the years completed, scope, major, and grade average…Well..I put so far 2004-2007. A grill nearly working two Jobs .Need Help and guidance .My neph?
My Nephew works Part Time for In home Health care that pays pretty good. But he have to take on a second job because the In Home Health assistance is not enough money. So he works at a grocery store part time too for partly the money an hour. They know he works also for In Home Health care . The manager at the grocery store asked him to come support to work for them.. My nephew said he would because we really need the money (we share rent ) but by Law he can only work 20 more hours if he wishes to keep his In Home Health care Job (which is basically over 30 hours a week) – in another job. How ever Now the grocery store official keeps giving him 30 hours a week as well. No situation how much he requests only 20 hours. There are not a lot of job in this town . He does not want to quit his job at the grocery store for measurable reasons and certainly not the In Home Health Care Job. A livelihood that requires driving..?
Have u ever had a job that required you to drive while on the clock?…( This press is not for truckdrivers or taxi drivers) If so, how was it? How far did you enjoy to drive?What was the job and be it worth it? I ask because I am starting job at a Rehabilitation center for people beside Traumatic Brain Inuries I will be helping them witth their everyday activities, transporting them to and from doctors visits and so forth. Its 16 miles from my house but I can be expeced to drive anywhere from 10-30 miles from the facility.. They do rate mileage but its only .45 per mile which is nothing. If I drive 28 miles I obtain like 12.00.so its nothing Im looking forward to (the driving) but I am an entry rank CNA and I need experience from somewhere. Im not really worried about driving itself, Im worried roughly speaking the wear and tear I will be putting n my car an how difficult it will be to drive contained by the snow in a couple months(I live in Michigan) They enjoy 2 company vehicles but only allow the character driving the furthest at the time to use it.

A Question in connection with my EI benefits, attending institution and seeking section time employment?
Here’s the deal: I have be collecting Regular EI benefits since the Spring and I worked a part time job over the summer. Service Canada agreed to provide funding for a post lesser program in another town. So I started school within September and Service Canada gave me authorization to quit my part time position because I have just cause (school be in another town). Since moving to this new town I established to take another part time position where on earth the pay is $8 for a maximum of 14 hrs per week.so here is my question: If I can find another chunk time position for $10 per hour with more flexible working hours during the week and the possibily of obtaining up to 18 hours per week would I be capable of quit my current part time job? Seeing that they are funding my anyone in school would they expect me to work at both places because it wouldnt in truth be possible seeing that one job has restricted hours of operation and I am contained by school full time all afternoon long. Should I call and ask permission or not? Do you regard it would be allowed? Any advice on this matter would be greatly appreciated!

I’m a recent high school grad and own don’t really have an interest in anything. Please don’t articulate take a couple of classes in college to see what interests you. I KNOW THAT! :D I’m sick and tired of audible range that over and over and over again. I need some real answers here. I am looking for a fun and exciting art. I don’t want a traditional 9-5 office job or anything, I want an adventurous mission that will allow me to travel the world. I don’t want to be a pilot or travel agent though. I want it to be well paying job, not a tour guide or anything. I knwo for sure I’m not cut out for math and science, so I’m genus of thinking business might be ideal for me…say International Business. I’m the type of creature who knows when I don’t like something and I know that I don’t close to anything because I’ve done tons and tons of research on every single job and career. I’ve also taken plenty of classes surrounded by anything that I think may interest me. I’m also trying to figure out what some hot career are in the future, but everything to be precise going to be hot and growing includes: IT and health, which I obviously don’t resembling. I know you might be thinking, why doesnt’ she figure it out on her own, but come on I really need some relieve here. I was home schooled, so don’t really hold any guidance. I just want to know of some unique, fun, adventurous, travel packed and exciting jobs that are going to be hot in the adjectives. I’m in a bit of a dilemma. The career track I really would like to take doesn’t money all that great, but I have my heart set on it. I’m only wondering other’s opinions, would you rather enjoy a job you love or a job next to a good pay? And why?

Someone here in the office found out my hourly wage and spread it around to others surrounded by the office. When I found out I was angry because I never told anyone and my wage is none of their business. They’re adjectives complaining, saying its unfair because I’m within a low level position but earn the same hourly wage as adjectives the other higher ranking (but non-management) office personnel. I work for a small familial owned contracting firm in Texas, near Houston. I’m concerned because these guys are going to petition and convince the owner to cut my wage to $10/hr…the going rate for my position surrounded by this area for a company this size. Texas is an at-will state so I think the owner can lawfully do this if he chooses. Considering how I remember my boss arguing with the owner over the phone about paying me $14/hr (owner looked-for $10/hr or less) I think he is likely to do it. I’m an Administrative Assistant making $14/hr. I answer the phone, bar city permitting and inspection issues, handle company and counter sales, back up for scheduling…when this guy isn’t contained by I fill in for him 100% (take adjectives his calls, schedule installations, trims, and final work) scan & email paperwork, and scan within paperwork for archival purposes. I also happen to be the only extremely computer savvy member of staff in the company. I provide software assistance for all packages including AutoCAD (have an honors level in drafting), troubleshoot the computers and issue a report to accounting who then contacts the outsourced upholding company to complete the repairs, maintain/upgrade all databases, create new applications, maintain/upgrade the in-house created software (originally created by my ex-boss who quit more rapidly this year). In your opinion…is $14/hr too much for my position considering my duties as listed above?

Criminal Record Systems in Canada

There is a lot of misunderstanding among the average Canadian about how criminal records are stored, shared, and of course, removed from the various criminal record systems in Canada. In order to understand how they operate, you have to understand what record systems are currently in place.

Criminal records are created under the terms of the Criminal Records Act, and in the case of youth records, subject to the Young Offenders Act.

When a local police force or RCMP agency arrests an individual on suspicion of a criminal offence, they create a local file on a local or regional police system, such as the Police Records Information Management Environment (PRIME) and the Police Information Retrieval System (PIRS). The fingerprints of the accused are typically taken at this time and are submitted to Criminal Records Information Management Services (CRIMS) for classification and entry into the system.

If the police/crown decides that they have obtained enough evidence to obtain a conviction, they forward the charges to the courts for prosecution. Once the court proceedings are over, the results of these proceedings (conviction, discharge, acquittal etc…) are entered onto the fingerprint form and the record is updated. Unless pardoned, criminal records then persist on CRIMS (CPIC) until you are 80 years old (* must also have been crime free for 10 years)

In Canada, no one can access another person’s criminal record without the consent of the person to whom the record relates. The exception to this rule is court records, which by law are a matter of public record. Also, Law enforcement, government agencies, including foreign governments such as the United States, Canadian courts, and other authorized agencies do not require your consent to access your criminal record.

Canadian Police Information Centre (CPIC)

The Canadian Police Information Centre (CPIC) was created in 1966 to provide tools to assist the police community in combating crime. Since 1967, CPIC is also a computerized information system available to provide all Canadian law enforcement agencies with information on crimes and criminals.

CPIC transmits requests by authorized agencies to several data banks primarily for law enforcement purposes. One of those data banks is the Criminal Records Information Management Services (CRIMS). CRIMS updates and maintains more than 600,000 criminal records annually and populates criminal record information to the Canadian Police Information Centre (CPIC) Identification Data Bank.

A criminal record file consists of an individual’s criminal charges and their dispositions, including convictions and discharges that are supported by fingerprint information.

A clear result from a CPIC check does not necessarily mean you have a clear criminal record. There are numerous criminal record systems nation-wide and then there are the provincial courts. Consequently, your criminal record can be stored, and accessed, in any number of ways.

Police Information Retrieval System (PIRS)

PIRS is the RCMP’s automated information management system used to store, update and retrieve information on case records/occurrences being, or having been, investigated. This electronic indexing system is used by the RCMP, some Municipal Police agencies, by Firearms Officers, and by other federal partners.

PIRS captures data on individuals who have been involved in investigations under the Criminal Code, federal and provincial statutes, municipal by-laws and territorial ordinances. According to the RCMP, in addition to details of an event in a brief synopsis (maximum of 240 characters), PIRS contains limited information relating to investigations and criminal histories.

Unlike CPIC, which essentially contains factual information (e.g., charges and convictions), PIRS may also contain information provided by witnesses, victims and other associated subjects that can be highly subjective, as well as the names of the witnesses, victims, and acquaintances of the accused individual.

PIRS also differs from CPIC in that it contains information on occurrences and incidents that never resulted in charges. That means you can have a PIRS record and not even know it.

Entries in the Police Information Retrieval System (PIRS) are assigned codes which bear significance on whether the details on an individual are disclosed in the RCMP’s standard four level criminal record check (form 3923e, Consent for Disclosure of Criminal Record Information).

The two major classifications are “Subject Chargeable” (SCH) and “Subject of Complaint” (SOC). Subject Chargeable implies a higher degree of assumed guilt of the individual in question. Subject of Complaint simply denotes that the individual has been brought to the RCMP/Police’s attention in an investigation and their name and personal details had to be entered into PIRS for the purpose of maintaining a record of the incident.

Subject Chargeable entries are often revealed in the fourth category of the RCMP’s four-section criminal record check, whereas SOC entries are typically not, as they generally denote information which is highly subjective.

Purging records from PIRS is notoriously difficult; however, professional purge services, such as those provided by Express Pardons, can be used to have the classifications of entries changed so that the information does not turn up in a criminal record check.

Provincial and Municipal Police Information Retrieval Systems

Similar to the RCMP’s PIRS database, Ontario has a police information retrieval system known as OMPACC, while Calgary has PIMS, Edmonton has PROBE, Regina has IRIS, etc. Formal and informal information sharing arrangements are in place between police services or agencies for the exchange of information in these databases.

If you have specific knowledge of your own personal experience/incident that might be included on a local or regional police information system, and you dont want do a multi-level record search, you may want to obtain information contained on you in provincial and municipal criminal record databases through freedom of information requests. Contact your provincial privacy commissioner for more information on how to make such a request.

Non-Conviction Records

Criminal charges that proceed to the courts for prosecution may not result in a conviction. Charges may be withdrawn, or the proceedings may be stayed after consideration of the circumstances. These records will remain in the federal criminal record repository of the Canadian Police Information Centre (CPIC), under restricted distribution, and in local police files, unless they are purged.

The Crown is empowered to control a prosecution proceeding, including the ability to terminate it and the ability to select the manner of termination. There are a number of ways in which a prosecution may be terminated other than by proceeding to a verdict. The Crown has the discretion as to which avenue to choose, and may:

Withdraw a charge at any time prior to a plea by the accused, or with the leave of the court, after a plea has been entered; Enter a Stay of Proceedings; or Proceed with the trial but elect not to call any evidence or to stop calling further evidence, and ask the judge or jury to acquit.

The avenues that a Crown prosecutor selects in terminating a prosecution have different legal consequences and the choice must depend on the particular circumstances involved. One of the consequences is the formation of a non-conviction record, in all cases. Even the verdict of acquittal  creates a non-conviction record in CPIC.

All too often, these non-conviction records turn up in criminal record screenings and background checks. You must apply for a record purge in order to have these records removed.

Why are charges withdrawn?

Crown determines that:

reasonable and probable grounds did not exist to lay the charge; there is no reasonable likelihood of conviction; it is not in the public interest to continue the prosecution; or the charge laid was incorrect and the Crown intends to proceed on a different (even a more serious) charge.

Why are proceedings stayed?

Generally, a stay is appropriate when proceedings in regard to a charge are being discontinued and the public interest requires that the Crown retain the right to recommence those proceedings within one year (or within such shorter limitation period as may pertain to the charge). When deciding whether to enter a stay of proceedings, the Crown considers the following factors:

the circumstances of the case and the reason for the inability of the Crown to proceed with the trial; the merits of the particular case (including the sufficiency of evidence and the likelihood of conviction); the relative importance of the case; the likelihood of recommencement.

Vulnerable Sector Searches

Whenever an organization with people in a position of trust (i.e. Scouts, senior citizen organizations, day care centres, etc…) deals with vulnerable people, they can request applicants to submit a Vulnerable Sector check.

Vulnerable persons are individuals who are at greater risk of being harmed than the general population because of their age, disability or handicap, or circumstances, whether temporary or permanent. They are generally defined as youth, elderly, or persons with disabilities.

The Vulnerable Sector Check is in addition to a criminal record check. During a VSC, a special database is checked to see if the subject has received a pardon for a criminal offence of a sexual nature. This requires the prior written consent of the applicant and can only be conducted by the police. Initially, the results can only be released to the applicant by the police. The police agency may only release the information to the requesting Vulnerable Sector organization with the prior written consent by that individual. If a record exists, it must be confirmed by the submission of fingerprints.

People who have received a pardon for any offence that is not of a sexual nature, will pass the Vulnerable Sector Search.

It is this reporter’s opinion that the amnesty crowd won’t die easily.Led by Senate majority leader, Harry Reid, D-Nev., Ted Kennedy, D-Mass., and company, they’ve tried five times to shove comprehensive immigration reform through and each time the American people, in their infinite wisdom, have rebuked them. The defeat of the DREAM Act was a major setback. Then came California Sen. Dianne Feinstein’s attempt to add the AgJOBS bill to the Farm Bill and again they fell flat on their faces. Feinstein admitted that amnesty efforts lacked popular support and its proponents could not overcome the opposition. The recent Bank of America fiasco is further evidence that when the people speak, the amnesty crowd listens. Customers tore up their BoA credit cards when the bank decided to give credit cards to illegals. It cost Bank of America a 32-percent drop in business. The threat is not over. Feinstein plans to bring up AgJOBS amnesty as a stand-alone bill later this year. But the amnesty crowd may be getting the message. Eighty House Democrats and Republicans teamed up to propose a new immigration enforcement bill saying they reject the Reid-Kennedy attempt at amnesty. A large number of rank-and-file Democrats agree with most Republicans that the first step should be a get-tough approach to border security. This new approach includes going after businesses that hire illegals; improving information sharing among the IRS, Homeland Security, and Social Security to track illegals; and increasing the number of enforcement agents at the border. We the people are speaking up. The people are fed up with plans to merge the United States into a North American Union with Canada and Mexico which would destroy American sovereignty.

Fed up with armed Mexicans illegally crossing our borders and assaulting Americans.
Fed up when Americans like border agents Ignacio Ramos and Jose Compean are sent to prison for defending us from drug-smuggling illegals.

Hot Government Career Tracks Include Customs and Border Patrol Jobs

Although hiring is lagging in most organizations, Customs and Border Patrol Jobs are widely available. The Department of Homeland Security is aggressively ramping up its force of Border Patrol agents.

Border Patrol Background

The United States Border Patrol is the uniformed part CBP, which falls under the Department of Homeland Security (DHS). According to CBP.gov, CBP was founded in 1924. That first year, Border Patrol started operations with 450 officers, and set to work regulating traffic across the country’s borders. Most of the patrol’s work was focused on stopping illegal immigration and alien smuggling.

The terrorist attacks of September 11, 2001 changed that mission. Now, Border Patrol’s focus has shifted toward prevention of terrorism through working to stop the flow of terrorists and terrorist weapons into the country. Border Patrol works to secure the 6,000 miles of international border with Canada and Mexico, and the 2,000 miles of coastal waters around Florida and Puerto Rico.

Border Patrol Jobs

In 2006, President George W. Bush announced his commitment to add 6,000 additional Border Patrol agents by the end of 2008.

With respect to Border Patrol staffing, Tara Dunlop (CBP Public Affairs Officer) said the agency has seen a dramatic increase since the President took office in fiscal year 2002. At the end of fiscal year 2001, CBP started with approximately 9,800 Border Patrol agents. Today, their numbers are more than 16,690. “Our goal for the end of 2008 is 18,000 Border Patrol agents on duty (‘boots on the ground,’) and we are on track to meet that goal,” Dunlop said.

Border Patrol has had to find creative new ways to recruit. Innovations include national recruiting in non-traditional regions of the country, sector-based recruiting, NASCAR sponsorship (now in its second year) the Minority Recruitment Strike Team, a Professional Bull Riders sponsorship and recruiting at U.S. military installations in the continental U.S. and abroad.

Additionally, a branding campaign has just launched, which includes television ads and an updated website that can be found at BorderPatrol.gov.

Agent Personality Traits

Dunlop said that the agency’s ideal recruit is someone “who prefers working outdoors and can successfully complete an oral interview, medical and fitness exams, drug testing, and background investigation.”

Dunlop also said that military veterans are strong candidates because “we offer an opportunity to protect America, in America. In fact, veterans make up more than 20 percent of the Border Patrol.”

While prior law enforcement experience is helpful, Dunlop said, it is not required because the Academy will provide agents with the knowledge and skills they will need to do the job.

Dunlop said that Spanish language proficiency is highly desirable.

Qualifications for Border Patrol Jobs

The CBP trains students from a variety of backgrounds, and Dunlop said the agency welcomes those with college degrees, and those with a military background have proven to be highly successful; approximately 25% of CBP are military veterans.

A law enforcement background may be helpful but is not required. Dunlop said CBP training standards remain at a high level to ensure new agents are adequately trained to meet the law enforcement standard.

Fluency in Spanish or the aptitude to learn Spanish is necessary. Spanish language immersion is provided at the Academy for those who need it.

Agent Training

Agents attend a rigorous training academy, currently located in Artesia, New Mexico, where they learn immigration, nationality and criminal law, and receive defensive techniques training, firearms training, and task-based Spanish language immersion training. All training is conducted at the Border Patrol Academy in Artesia, New Mexico. Candidates receive full pay and benefits during training.

The basic training program is further supplemented by a 12-week National Field Training Officer Program, and a minimum of two months on-the-job training with a journeyman-level agent during which the interns’ performance will be evaluated.

Where will I work?

Initial assignments for Border Patrol agents coming out of the Academy will be in Arizona, California, New Mexico, and Texas.

What’s the Downside?

One disadvantage to Border Patrol work is that it can be emotionally draining to turn people away from the U.S. country, particularly when young children are involved and you realize parents are only trying to give their families a better life. For this reason, people who understand the Border Patrol mission and believe in its importance are better-equipped to handle the job.
